Scope of Service

Apertus coordinates the service of legal documents through experienced local process servers in Ontario. Our role is to:

  • Receive your service request
  • Confirm details and timeline
  • Engage qualified local servers
  • Generate and deliver affidavits of service
  • Provide administrative support

We do not:

  • Provide legal advice or strategy
  • Represent you in court
  • Determine the validity of documents to be served
  • Advise on procedural requirements or rules of court
  • Act as your lawyer

Responsibility for Accuracy

You are responsible for ensuring that:

  • All information you provide to us is accurate and complete
  • Documents are properly prepared and authorized for service
  • Servee details (name, address, description) are correct
  • You have the legal authority to serve these documents

Service attempts rely on the accuracy of the information you provide. If information is incorrect or incomplete, service may fail, and we cannot be liable for inaccurate client-supplied details.

Rules of Civil Procedure

Service of documents in Ontario is governed by the Rules of Civil Procedure and applicable court rules. It is your responsibility to understand these rules or consult a lawyer about them. Apertus makes reasonable efforts to comply with Ontario procedural rules, but ultimate responsibility for proper service rests with you.

Affidavit of Service

Affidavits of service are prepared based on information reported by the local process server who conducted the attempt. You must review the affidavit carefully before filing it with the court. If you believe any information is incorrect, you must notify us immediately and before filing.

We do not guarantee the accuracy of information provided by third-party servers. We use reputable, experienced local servers, but errors can occur. You are responsible for reviewing and verifying the affidavit before court filing.

Limitation of Liability

To the fullest extent permitted by law, Apertus and its representatives are not liable for:

  • Errors or omissions in service attempts
  • Inaccuracies in affidavits of service based on server-reported information
  • Loss, damage, or adverse outcomes resulting from service failures
  • Missed deadlines or procedural problems
  • Any indirect, incidental, or consequential damages

This limitation does not apply to gross negligence or wilful misconduct on our part.

Service Failures

Service attempts may fail for reasons beyond our control, including:

  • Servee is not at provided address
  • Address information is incorrect or outdated
  • Servee refuses service
  • Access to location is restricted
  • Workplace security or other barriers

In cases of failed service, we will report the attempt and may recommend substituted service or other options. You must then decide how to proceed in consultation with your lawyer.

Insurance & Professional Standards

Apertus operates under standard commercial practices for process serving coordination. We carry business liability insurance and work exclusively with experienced local process servers in Ontario.
